These Terms are governed by the laws of Queensland, Australia and are consistent with the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)). Nothing in these Terms limits or excludes any rights you have under the Australian Consumer Law that cannot be excluded by contract.
The Parties & Definitions
"Cinestudios", "we", "us", or "our" refers to Cinestudios Pty Ltd (ABN: [YOUR ABN]), operating at Helensvale, Gold Coast, Queensland and Melbourne, Victoria.
"Client", "you", or "your" refers to the individual or entity purchasing services from Cinestudios.
Production Services — CINEREEL™, Commercial & Film
Cinestudios provides professional, cinematic showreel services for actors, including original scripted scenes, filming, editing, colour grading, and sound mixing. All showreels are created as promotional tools only and are intended to support casting submissions, portfolios, IMDb listings, Showcast, StarNow, and similar professional and industry uses including U.S. O-1 visa applications.
Each package includes only the services explicitly outlined at the time of booking. Any additional scenes, shoot time, reshoots, revisions beyond those included, or creative changes outside the agreed Scope of Work may incur additional fees at Cinestudios' standard rates.
Cinestudios retains full creative discretion over production and post-production decisions, including but not limited to shot selection, editing structure, pacing, colour grading, sound design, and music placement, to ensure a professional and industry-appropriate result.
Revisions apply only to post-production adjustments. Reshoots are not included unless expressly agreed in writing and may incur additional fees.
Cinestudios makes no guarantee of casting outcomes, representation, employment, awards, publicity, visa approvals (including U.S. O-1 visas), or career progression as a result of any service provided.
Payment Terms
Unless otherwise stated, a non-refundable deposit of 50% of the total package price (including any selected add-ons) is required to commence script development, scheduling, or production preparation. Payment of the deposit constitutes acceptance of these Terms & Conditions.
The deposit may be paid by:
All prices are inclusive of GST unless expressly stated otherwise. Tax invoices are issued upon request.
The remaining balance must be paid no later than seven (7) days prior to the scheduled shoot date. Cinestudios reserves the right to suspend or cancel services if full payment has not been received by this date.
Additional edit requests, revisions beyond the included scope, overtime due to client unpreparedness, or any services outside the agreed Scope of Work are billed at Cinestudios' standard rate of $90 per hour. Additional charges are invoiced separately and are due within 14 days of invoice.
Cinestudios will not commence or continue work where payment obligations are not met. Cinestudios reserves the right to withhold delivery of the Final Product until all outstanding amounts have been paid in full.
Cancellations & Postponements
Postponements made within five (5) days of a scheduled shoot may incur a 25% postponement fee based on the total package value. Postponements exceeding four (4) weeks from the original booking date may require an additional deposit to recommence services.
For packages involving multiple shoot days, all shoot days must be completed within a reasonable timeframe agreed by both parties. Delays exceeding four (4) weeks may be treated as a postponement and subject to applicable fees.
In the unlikely event that Cinestudios must cancel or postpone a confirmed booking due to circumstances beyond our reasonable control, we will provide as much notice as possible and offer either a full refund of all amounts paid or a reschedule at a mutually convenient date at no additional cost to the client.
Client Responsibilities
Clients are expected to arrive on time, prepared, and professional. Failure to do so may result in reduced filming time or additional charges. Cinestudios reserves the right to pause or terminate a shoot where behaviour compromises safety, legality, professionalism, or production quality. No refunds will apply in such cases.
If filming exceeds Allocated Shoot Time due to client lateness, lack of preparation, or client-requested changes, additional time may be charged at Cinestudios' standard hourly rate, subject to crew availability.
Clients are responsible for wardrobe, props, and personal refreshments unless otherwise agreed in writing. Make-up is strongly recommended. If not using a professional make-up artist, clients are responsible for arriving camera-ready.
Unless location sourcing is included or purchased as part of the client's package, the client is responsible for securing suitable locations and all necessary permissions, access, and permits. Cinestudios accepts no liability for issues arising from unpermitted or unsuitable locations provided by the client. Additional travel, parking, tolls, or distances beyond standard operating areas may incur extra charges, confirmed in writing prior to the shoot.
Where Scene Partner Casting has been selected as an add-on, the following conditions apply:
Delivery & Timelines
Estimated delivery is 3–4 weeks following completion of filming, subject to workload and scheduling. Rush delivery may be available upon request and may incur additional fees. Cinestudios is not liable for client commitments, auditions, or deadlines made within the standard post-production timeframe.
Final deliverables are provided as digital files in HD format, suitable for casting platforms including Showcast, StarNow, IMDb, Vimeo, and YouTube. Hosting and management of third-party platform accounts are the sole responsibility of the client.
Raw footage is not supplied unless explicitly agreed in writing prior to the shoot. Where raw footage supply has been agreed, additional fees may apply.
Where an Alternate Performance Cut add-on has been selected, the alternate edit is created from existing footage only. No additional filming is conducted for this deliverable.
Where an Original Composer Score add-on has been selected, the music cue is composed specifically for the client's scene(s). Music licensing for standard delivery platforms is handled by Cinestudios and included within the scope of this add-on.
Usage & Copyright
Upon receipt of full payment for all services rendered, Cinestudios grants the client a perpetual, non-exclusive, royalty-free licence to use the Final Product for personal professional promotion, including:
Re-editing, altering, remastering, or removing Cinestudios branding from the Final Product without prior written permission is prohibited. The client may not commercially exploit, license, or broadcast the Final Product to third parties without the prior written consent of Cinestudios.
Unless otherwise requested in writing prior to the production date, Cinestudios may use footage, stills, and excerpts from the Final Product for portfolio, promotional, website, social media, and marketing purposes.
Equipment Hire
Submission of a hire enquiry constitutes an expression of interest only. Equipment hire is not confirmed until the client receives a written confirmation and quote from Cinestudios, and required payment and/or bond has been received. All pricing shown on the website is indicative and based on daily hire rates. Final pricing is confirmed in writing.
Hire fees are payable in full prior to collection or delivery of equipment unless otherwise agreed in writing. A security bond is required for all camera body and drone hires, and may be required for other high-value items at Cinestudios' discretion. Bond amounts are confirmed in the hire quote and are returned within two (2) business days of equipment being returned in full and in undamaged condition.
The hire period commences when equipment is collected by or delivered to the client, and ends when equipment is returned to and accepted by Cinestudios. Equipment must be returned by the agreed return date and time. Late returns are charged at the applicable daily rate for each additional day or part thereof.
By accepting equipment on hire, the client agrees to:
Cinestudios operates a tiered protection system based on the total replacement value of equipment in any single hire:
Cinestudios reserves the right to decline any hire enquiry where adequate bond, identification, proof of production, or insurance cannot be confirmed to our satisfaction, without obligation to provide reasons.
The client is responsible for any loss, damage, or theft of hired equipment from the time of collection until return and acceptance by Cinestudios. In the event of loss or damage, the client must notify Cinestudios immediately. The cost of repair or replacement at current market value will be charged to the client. Where the bond does not cover the full cost, the client remains liable for the outstanding amount. Cinestudios strongly recommends hirers obtain appropriate insurance coverage for equipment on hire.
Liability & Force Majeure
To the fullest extent permitted by law, Cinestudios' total liability to the client for any loss or damage arising from or in connection with any service is limited to the total value of services paid by the client for the relevant engagement. No liability is accepted for indirect, consequential, or economic losses.
Nothing in these Terms excludes, restricts, or modifies any right or remedy the client may have under the Australian Consumer Law. Where services fail to meet a consumer guarantee, the client may be entitled to a remedy under the ACL.
Cinestudios shall not be liable for delays or cancellations caused by events beyond reasonable control, including but not limited to adverse weather, illness, equipment failure, location loss, or government restrictions. In such cases, Clause 4.4 applies.
Disputes
Both parties agree to act in good faith. Creative dissatisfaction alone does not constitute a breach of contract.
Any disputes must first be raised directly with Cinestudios at info@cinestudios.com.au. If unresolved within 14 days, either party may seek independent resolution through the Queensland Civil and Administrative Tribunal (QCAT) or applicable state tribunal.
Privacy
Client information is collected, stored, and used in accordance with our Privacy Policy, available at www.cinestudios.com.au/privacy. Client information is kept confidential and will not be shared with third parties except as required by law or as outlined in our Privacy Policy (including payment processing via Stripe and form submission processing via Formspree).
General
All prices are inclusive of Goods and Services Tax (GST) unless expressly stated otherwise. Tax invoices are issued upon request.
Cinestudios reserves the right to update these Terms & Conditions at any time. The current version will always be published on our website. Continued engagement with Cinestudios services constitutes acceptance of any updated Terms.
If any provision of these Terms is found to be invalid or unenforceable, that provision will be severed and the remaining Terms will continue in full force and effect.
These Terms are governed by the laws of Queensland, Australia. The parties submit to the non-exclusive jurisdiction of the courts of Queensland.
